I – Introduction and company details

This text constitutes a Legal Notice and Conditions of Use governing access to, browsing on and /or use of the Web Site of Cyes Infraestructuras, S.A. (hereinafter cyes) and other concerns forming the cyes Group: Vareser 96 S.L. (hereinafter known as subsidiary company), located on the URL www.cyes.es.

II – Access to the Web Site

Access, browsing and use of the Web Site entail and imply the user’s acceptance of this Legal Notice and Conditions for Use that this includes. Anyone accessing, browsing, using or taking part in the services and activities, whether free or charged for, offered on the Web Site is thus given the status of User.

As regards certain services and contents of the Web Site, the User from this time on fully and unconditionally accepts these general conditions, as well as any particular conditions which may where applicable complement, modify or replace the general conditions. In the event of any contradiction, the terms of the particular conditions shall prevail over the general conditions.

Any improper use of the Web Site shall be the full responsibility of the user.

Cyes reserves the right and may unilaterally, with no prior notice if it deems fit, modify the structure and design of the Web Site, modify and eliminate the services, the contents and the conditions for access and/or use of the Web Site. In the event of the User finding links with other pages on the Web page by means of different buttons, banners, etc., these will be managed by third parties. Cyes has no power nor human nor technical means to know of, control or approve all the information, contents, products or services supplied by other Web Sites to which links may be made from the Web Site.

Cyes can consequently assume no liability for anything to do with the Web page which might be established by a link from the Web Site. For announcement purposes and without intending to be exhaustive, this specifically includes its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents in general.

In this respect, if the Users were effectively to learn of the unlawfulness of any activities carried out through these third parties’ web pages, they should immediately make this known to cyes for purposes of proceeding to disable the access link to any such site.

Establishing any kind of link from the Web Site to any other Web Site shall not imply that there is any kind of relationship, cooperation or dependence between cyes and the party responsible for the other Web Site.

VI - Indefinite nature

The duration of the rendering of the Web Site service and the services is indefinite. For this reason, the effectiveness over time of this Legal Notice coincides with the time of its exposure until these are fully or partially modified, at which time the modified Legal Notice will come into Force.

With no detriment to the foregoing, cyes reserves the right to interrupt, suspend or terminate rendering of the service of the Web Site or any of the services integrating this, in the same terms as stated in condition three, with no possibility for the User to demand any compensation. After any such termination the prohibitions for use of the contents previously given in this Legal Notice will continue to be in force.

In spite of all this cyes declares that it has adopted all the means necessary, within its possibilities and the state of the art, to guarantee the operation of the Web Site and to prevent the existence and transmission of viruses and other components damaging to Users.

VIII – Intellectual property rights

In order to maintain any possible intellectual property rights, in the event of any user or third party considering that there has been any infringement of their legitimate rights through bringing any specific content onto the Web Site, the cyes Group must be informed of this immediately so that it can take any appropriate measures, stating:

The trademarks of cyes, its Areas of Activity with their relevant designations and the corresponding graphic marks are all registered trademarks and their reproduction or use is prohibited without the holder’s consent.

The legitimacy of any intellectual or industrial property rights covering the contents provided by third parties is the latter’s sole responsibility.

IX – Applicable law and jurisdiction

This Legal Notice and the relations established between the Firm and the User, in particular the hearing and judgment of any legal action, disagreements or differences that might arise, shall be governed and judged according to what is laid down in Spanish norms on applicable legislation and competent jurisdiction. Nevertheless, for any cases in which the norms envisage the possibility of the parties submitting to a jurisdiction, the Firm and the User, expressly waiving any other jurisdiction to which they might be entitled, shall submit any controversies and/or litigation for hearing by the Courts of the city in which the Firm has its address as stated in this Legal Notice.
